• SMS Terms and Conditions

    These Terms and Conditions ("Terms") govern your use of the SMS messaging service described below (the "Service"), operated by Alicia Cheung ("we," "us," or "our") and accessible via the website at aliciacheung.com. By sending a message to the Service's phone number, you agree to these Terms.

    Program name: Personal SMS Assistant

    Description: A two-way SMS service that lets the account owner send notes, ideas, and reminders by text; each message is automatically categorized and logged to a private spreadsheet, and a short confirmation is sent in reply.

    Message frequency: Variable — you will only receive messages in direct reply to messages you send. Typically one reply per inbound message.

    Message and data rates: Message and data rates may apply. The Service itself is free, but your mobile carrier may charge for messages sent or received.

    Support: For help, reply HELP to any message, or email alicia@aliciacheung.com.

    Opt-out: To stop receiving messages at any time, reply STOP. You will receive one final confirmation and no further messages. To resume, reply START.

    1. Program Details

    The Service is a transactional, two-way SMS program operated for the personal use of the account owner. The account owner texts a dedicated phone number with notes, ideas, reminders, and similar content; the Service classifies each message, stores it in a private Google Sheet belonging to the account owner, and replies with a short confirmation such as "Logged: Reminder · due tomorrow."

    2. Message Frequency

    Message frequency is variable. The Service only sends messages in direct reply to messages you initiate, so the number of messages you receive depends entirely on how often you text the Service. Typically, you will receive one confirmation reply per message sent.

    3. Message and Data Rates

    Message and data rates may apply. Standard rates from your mobile carrier apply to both messages you send to the Service and messages you receive from it. The Service itself does not charge you directly.

    4. How to Get Help

    For help or support at any time, reply HELP to any message from the Service. You will receive a reply with support contact information. You may also email us directly at alicia@aliciacheung.com.

    5. How to Opt Out

    You can cancel the Service at any time by replying STOP to any message. After you reply STOP, you will receive one final confirmation message, after which no further messages will be sent from the Service. To resume messaging at any time, reply START.

    6. Supported Carriers

    The Service is compatible with all major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages.

    7. Eligibility and Intended Use

    The Service is intended for personal use by the account owner. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You agree to use the Service only with phone numbers you own or are authorized to use.

    8. Acceptable Use

    You agree not to use the Service to:

    • Transmit unlawful, harassing, defamatory, abusive, threatening, or otherwise objectionable content.

    • Impersonate any person or misrepresent your affiliation with any person or entity.

    • Attempt to gain unauthorized access to the Service or any underlying systems or data.

    • Interfere with or disrupt the Service or its associated networks.

    • Use the Service for any commercial purpose, bulk messaging, marketing, or promotional activity.

    9. Privacy

    Your use of the Service is also governed by our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

    10. Service Availability

    We make reasonable efforts to keep the Service available but do not guarantee uninterrupted access. The Service depends on third-party providers (including Twilio, Google, and Anthropic), and outages, delays, or failures of those providers may affect message delivery or logging. We are not responsible for lost or undelivered messages.

    11. Disclaimers

    The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted.

    12. Limitation of Liability

    To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data or loss of profits, arising out of or relating to your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed one hundred U.S. dollars (US$100).

    13. Indemnification

    You agree to indemnify and hold harmless Alicia Cheung from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or violation of these Terms.

    14. Termination

    We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by replying STOP.

    15. Changes to These Terms

    We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

    16. Governing Law

    These Terms are governed by the laws of the United States and the state in which the account owner resides, without regard to conflict-of-law principles.
